MINUTE OF ORDER

 

UPON the application of the Claimant by Application Notice dated [ ] December 2002

AND UPON hearing counsel for the Claimant and for the First Defendant IT IS ORDERED THAT:-

(i) the interim costs order in favour of the First Defendant made herein pursuant to CPR Rule 44.3 (8) on 5th May 2000 by the Hon. Mr Justice Gray be discharged;

[alternatively, (ii) the interim costs order pursuant to CPR Rule 44.3 (8) made herein on 5th May 2000 by the Hon. Mr Justice Gray be stayed pending further order, and the Claimant do have permission to appeal against it, time for service of the Appellant's Notice being extended until [date];]

(iii) unless the First Defendant do lodge its bill of costs for detailed assessment on or by [date], it be debarred from proceeding to a detailed assessment of its costs;

(iv) that the First Defendant do pay to the Claimant his costs of this application, summarily assessed in the sum of £[  ].
